Terms of Service

1. Platform and eligibility
FreelySeat is a peer-to-peer marketplace connecting ticket sellers and buyers. We are not a ticket vendor; we are a platform that facilitates private sales.
You must be at least 18 years old and capable of forming a binding contract to use FreelySeat. By creating an account, you represent that you meet these requirements.
2. Seller obligations
Sellers must only list tickets they legally own and have the right to transfer. Listing fraudulent, counterfeit, or already-transferred tickets is prohibited and will result in immediate account termination.
Sellers using Instant Transfer must upload their tickets for verification before the listing goes live. Sellers using Standard Transfer must complete the transfer within 24 hours of a sale.
Sellers who fail to complete a transfer within the required window will have the sale reversed and may have their account restricted.
Prices may not exceed $10,000 per ticket. FreelySeat reserves the right to remove listings that appear to manipulate prices.
3. Buyer obligations
Buyers must confirm receipt of tickets within 72 hours of receiving them. Failure to confirm will result in automatic release of funds to the seller.
Disputes must be opened through the FreelySeat platform, not through your payment provider. Chargebacks initiated outside of our dispute process may result in account suspension.
4. Fees
FreelySeat charges sellers a seller fee of 10% of the listed price, deducted from the seller's payout. Sellers receive the listed price less this seller fee.
The price displayed to buyers is all-inclusive. It includes a 5% processing fee that covers payment handling; no additional fees are added at checkout. This processing fee is non-refundable.
Platinum tier members pay no processing fee.
5. Payments and payouts
Buyer payments are held securely by our payment processor (Stripe) until the transfer is confirmed complete. FreelySeat does not hold buyer funds directly.
Seller payouts are released within 3 business days of transfer completion. Payouts are processed to the bank account on file.
6. Disputes and refunds
If you believe a ticket was not received, was invalid, or did not match the listing, you may open a dispute through your account dashboard within 72 hours of the transfer.
FreelySeat will review the dispute and may request evidence from both parties. Our decision is final. If a refund is warranted, it will be issued to the original payment method within 5-10 business days.
7. Prohibited conduct
You may not: create multiple accounts, purchase your own listings, manipulate trust scores, list tickets for events you are not attending (scalping with intent to defraud), or use FreelySeat for any unlawful purpose.
We reserve the right to suspend or terminate any account in violation of these terms without prior notice.
8. Limitation of liability
FreelySeat is not responsible for the actions of third-party sellers or buyers, event cancellations by organizers, or losses arising from the use of the platform beyond the total amount of the disputed transaction.
To the maximum extent permitted by law, FreelySeat's liability to any user is limited to the fees paid by that user in the 12 months preceding the claim.
9. Changes to these terms
We will notify registered users by email at least 14 days before any material changes to these Terms of Service. Continued use of FreelySeat after the effective date constitutes acceptance of the updated terms.
